Recovery action

Payment is due by 10 monthly instalments. If payments are not kept up to date, recovery action will commence and if payment is still not made a summons will be issued followed by a liability order applied for through the magistrate's Court. Costs will be added to the payer's account.

Once a liability order is obtained the Council can recover any monies due by various methods, such as:

  • attachment to earnings
  • attachment to benefits
  • arrangement
  • use of enforcement agents (this will incur further costs)

Difficulty paying your bill?

Anyone having difficulty paying their bill should contact us before the matter reaches the enforcement agent stage. Use of enforcement agents is a last resort and we always encourage payers to contact the council to discuss payment.

Enforcement agents

Enforcement agents, sometimes called bailiffs, are employed in appropriate cases of non-payment of monies due to the Council.

Enforcement agents are instructed to collect the debt outstanding where a liability order has been obtained through the Magistrates Court and all other efforts to collect the debt have failed. Enforcement agents collect their costs directly from the charge payer and therefore the amount payable can be greatly increased.
