Enforcement
When a person carries out development without the benefit of planning permission the Council has a duty to consider what action to take.
Hambleton attempts to resolve the matter without recourse to formal enforcement action. But there are occasions where immediate firm action is required - and a decision to take enforcement action must always be well founded.
If a person has carried out a development without the benefit of planning permission they are invited to submit a retrospective planning application. It is considered on its merits and no weight is given in the decision making process to the fact that the development has already been carried out.
The Council has prepared a new policy to guide developers, landowners, neighbours as well as staff at the Council and members of the District Council and Town and Parish Councils on the service they can expect from the Council in undertaking Enforcement and Compliance work. It is currently in draft form and comments are invited. The following is a link to this document.
