Allocations DPD

Allocations Cover AdoptedIn December 2010 the Council adopted its third Development Plan Document (DPD). This completes the suite of DPDs making up the Local Development Framework (LDF). The Allocations DPD sets out sites for development (e.g. housing and employment) and defines Development Limits for the main settlements in the area of Hambleton outside the North York Moors National Park. This plan covers the period up to 2026.

The Allocations DPD underwent public examination in May 2010 following several years of community consultation. The independent Planning Inspectors who approved the DPD were satisfied that it met the requirements of the Planning Act and Regulations, subject to a few minor alterations.

Annex 5 of the DPD contains the Council's Proposals Map, which shows the adopted LDF policies and proposals. These include sites for housing, employment and recreation, as well as areas for protection and safeguarding, including Green Belt, transport schemes, shopping centres and historic and nature conservation sites. This Proposals Map replaces that which was adopted in February 2008 as Annex 5 of the Development Policies DPD.

Legal challenge

The Allocations DPD was subject to a legal challenge by Mr Edward Barker in relation to the allocation of land at South West Thirsk (Sowerby Gateway) in preference to his sites to the North East of Thirsk. The grounds for challenge related to:

  • the Council not considering Mr Barker's representations correctly;
  • the Inspectors not dealing properly with the Government's proposed abolition of Regional Spatial Strategies.

These were matters on which the Council previously took legal advice before deciding how to proceed with the plan.

This matter was due to be heard at Leeds High Court on 23rd May 2011, but the Judge determined that the claim had been made out of time and it was therefore dismissed. There has been an appeal to the Court of Appeal, which was due to be heard in mid January 2012, however this has now been postponed. This is because parties involved in a similar case concerning Rugby Borough Council have asked for their case to be joined with Hambleton's case. The Court of Appeal has agreed to this and the matter is to be heard over 25/26 April. If successful, the substantive claim would have to be decided back in the High Court. The Allocations DPD however remains adopted as of 21 December 2010.

A calculation mechanism has recently been approved for developer contributions towards the Bedale Footpath and Cycleway Scheme. The document was approved by the Council on 29 November 2011 and sets out the requirements and calculations which developers, who are promoting schemes within the defined 'contribution zone', must use to identify required financial contributions. The Bedale Footpath and Cycleway Scheme is identified in the Hambleton LDF Allocations document as Proposal BC3.

A masterplan has now been produced for one of the Allocations DPD's strategic sites, the North Northallerton Development Area. In November 2010 Cabinet Members approved a document which calculates contributions for the North Northallerton Link Road. Anyone submitting a planning application for a development within the parishes of Brompton, Northallerton or Romanby, will need to refer to this document to see how the charging schedule applies to them.
