(1) Householder developments are applications for alterations to existing dwellings and development within gardens. This accounts for about half of the applications dealt with in Hambleton District.

All Councils are required to report performance against 3 key areas these are:-

(2) Major developments are schemes of 10 or more dwellings and developments of more than 1000sqm of floorspace

(3) Minor development are schemes of 1 to 9 dwellings and schemes of less than 1000 sqm floorspace

(4) Other developments are Changes of use, Advertisements, Listed Building Consents, Certificates of Lawfulness, Notifications and Householder schemes (this figure is shown on its own in the first box).

Post decision amendments to planning applications.

The Government introduced changes to the planning system on 1st October 2009 to formally allow minor changes to be made to previously approved schemes. This allows two forms of changes to be made: changes can be made that are "Non-material amendments" and "Material minor amendments". In common with many Councils Hambleton District Council had operated a system of non-material minor amendments but this had risks as it was not enshrined in planning law. The changes that have been introduced mean that the decisions made are now in accordance with planning law. The "Material minor amendments" procedure is akin to an application to vary a planning condition and the procedures already in place are largely unchanged.

The new procedures are similar to those operated by Hambleton District Council. Fees have been introduced from 26th February 2010 as follows:

Applications

The new application known as Thornton Gate, Thornton-Le-Moor for outline application for a continuous care retirement community for 150 unit (100 independant living units and 50 assisted living units) with associated parking, social, medical, fitness and wellbeing, administration, service, ancillary facilities and a range of external facilties within the grounds is available to view on PublicAccess using reference number 10/00161/OUT.

A proposal for outline planning permission for re-development for housing, open space and electricity sub station at the former Abattoir, Bedale Road, Aiskew is available to view on PublicAccess using reference number 10/00484/OUT.


The applicaton for planning permission for or 2 wind turbines at Hilton Road Seamer (application reference number 09/00859/FUL which can be viewed on PublicAccess) was refused on 18.09.2009 An appeal was submitted on 12 Oct 2009 against the refusal. The Grounds of Appeal can be read on PublicAccess The Appeal Inquiry is to commence on 29 March 2010 and is expected to run for 3 days. Other current issues.

Bagby Airfield

The refused application for Bagby Airfield (reference no. 09/00231/FUL) is now the subject of an appeal. The appeal is to be dealt with as a Public Inquiry no date has been set. An appeal has also been lodged regarding the Enforcement Notice served by the Council, two further application for the retrospective approval of the geo-textile matting and concrete surfacing (09/03959/FUL) and replacement helicopter landing pad and jet fuel stop facility (09/04039/FUL) which were refused in March 2010 have also been appealed. It is expected that the Planning Inspectorate will be asked to consider all the appeals together.

The local campaign group Action4Refusal have achieved 'Rule 6' status in the forthcoming appeals.I

No date has been set for the joint Inquiry as yet

Siting of 4 wind turbines at Bullamoor (reference no. 08/04984/FUL) details are available on PublicAccess. The application was considered and defered at the Committee meeting on 12 November 2009 following representations relating to radar interference and aircraft safety. No date has been set for the further consideration of the application.

Earlier updates

 

The application submitted for new homes to be built on the site of York Trailers on Yafforth Road is the subject of a "Planning Performance Agreement" consultation is ongoing as is design work on the proposal. The application reference number is 09/00795/FUL and details can be viewed on PublicAccess. The end date for the Planning Performance Agreement has been extended to the end of April 2010.

There has been the introduction of a new Householder Appeal Service and changes to the appeal process. Full details of this may be obtained from Planning Portal website Opens in a new window.

A Scoping Opinion has been provided for a windfarm near Appleton Wiske. A planning application has not yet been made. The Scoping Opinion reference no.08/03771/SCR can be viewed on PublicAccess

A new version of Public Access will become available soon.

You will still be able to view details of the application but if you register as a user then you can 'save' searches and the system will automatically notify you of new applications and changes to any application that matched your search criteria.

For example if you are interested in new applications in the Parish of Easingwold you will be able to run an "Advanced Search" for the Parish of "Easingwold", for cases that have a status of "Application Received". You can then save the search and have the option of being emailed when new cases are received. You can opt out of receiving the email alert of the search results at any time.

You never need to miss out on knowing about applications, appeals or enforcement cases in your area.

 

 

Changes to Householder Permitted Development Rights

The changes relax some rules but tighten others.

Although existing requirements for some developments - including single storey extensions - have changed, the new rules mean that some previously exempt proposals may now need planning permission. Hambleton's development management team are warning that failure to take the new legislation into account may lead to conflict with local planning policies and ultimately possible enforcement action.

Householders, builders, glazing and conservatory firms are being urged to check out the rules before undertaking work - information sheets are being sent out to local companies telling them that planning permission may now be needed for:

- the installation or repair of driveways

- extensions or conservatories to the side of a house

- extensions or conservatories to the rear of a house within two metres of a side boundary

- the construction or erection of any building (shed, garage) within two metres of any boundary

- decking over 30cm in height at any point

- installation of side windows to a house

 

"These developments are only a selection of the changes so it is vital that we are contacted before any building work begins," said Hambleton's Head of Development, Maurice Cann.
"We can give free advice. It is the owner's responsibility to ensure that any development has the necessary permission. The consequences of failing to obtain planning permission fall upon the householder, not the builder."

Enquires to the district council should be made through forms available in the planning section Hambleton residents living within the North Yorkshire Moors National Park can use the same form but need to refer the matter to the park's Helmsley Office.

 

Discharge of Planning Conditions

On 6th April 2008 changes to the fee regulations introduced a charge for the handling requests for confirmation of compliance with planning conditions attached to planning permissions. From 1st July 2008 Hambleton District Council will commence charging for this service.

This document explains how Hambleton District Council will handle this new requirement. The process of handling requests for confirmation of compliance with planning conditions or the submission of details for consideration in order to secure compliance with conditions remains unchanged. Discussion prior to the submission of details is encouraged if there is any doubt over what is required. The validation checklists will be a helpful reference point of the type and level of detail that is required to deal with many types of condition.

Fees are payable for each request for confirmation of compliance with planning conditions (referred to as "written discharge of conditions"). It makes no difference how many conditions are included in the request the fee remains at either £25 for householder development and £85 for other types of development. If several requests are made to discharge conditions relating to the same application the fee will be payable upon submission of each request.

Government set out the details of the new fee arrangements in the "Town and Country Planning (Application and Deemed Applications) Fees (Amendment)(England) Regulations 2008 (Statutory Instrument 2008/ 958) and in the Department for Communities and Local Government Circular 04/2008. The Council will register your request for discharge of conditions and acknowledge this request and commence work on discharging the conditions once the appropriate fee has been paid. You will be given a reference number for the request and the name of the case officer. The Council will endeavour to respond to your request within 21 days; however the 8 week period in which to give a decision as set out in the Town and Country Planning (General Permitted Development) Order 1995 still applies.

The Council will either confirm compliance with the requirements of the condition within 56 days or will explain to the applicant what remains to be done. Where further work or information is required the submission of this information will not be treated as a 'new request' and will not attract a further fee. If the requested confirmation of compliance can not be given on the basis of the initial request and the necessary amendments or additional information is not forthcoming the Council will write and advise that the confirmation of compliance can not be given. This will normally happen before the expiry of the 56 day period. In this instance a new request will incur a further fee. (Unlike resubmission of planning applications there is no 'free-go' for repeat requests, each new request will incur a fee.)

The Development Management section handles almost all proposals for new land and building uses, new buildings, alterations and extensions to existing buildings and houses and advertisements. It also looks after works to hedgerows and trees covered by Tree Preservation Orders.
The unit gives advice and information on a variety of issues and offers a service whereby it can inform residents of the requirements of any planning permission.

 

Street Naming and Numbering

If so you will need to register for an address with Hambleton District Council's Street Naming and Numbering Officer.

Please note that there is a charge for this service from 1st April 2010 the fees are:

Large Developments which includes a new road name will be £170 for 10 properties or less, plus £20 for each additional property
Small developments which do not include a new road name will be £65 per property
Re-naming of a property will be £25 per property
