Article 4 Directions
Properties within a Conservation Area are subject to tighter planning controls than those outside such an area. As a result, many works to properties will require the benefit of planning permission, however there are still works which are considered 'permitted development'.
In certain circumstances, works which are considered 'permitted development' may be harmful to the character and appearance of the street scene. In such cases the Council may consider making an Article 4 Direction to restrict 'permitted development rights'.
Article 4 Directions are issued by the Council in circumstances where specific control over development is required, primarily where the character of an area of acknowledged importance would be threatened. There are two different types of Article 4 Direction available to the Council.
Article 4 (1) Directions can be used to withdraw permitted development rights on any type of land or building, whether or not fronting onto a highway, waterway or open space.
Article 4 (2) Directions may be used to withdraw permitted development rights for a prescribed range of development which materially affects aspects of the external appearance of dwellinghouses in Conservation Areas. This includes the erection, alteration or removal of a chimney; various kinds of development fronting a highway, waterway or open space, such as the enlargement, improvement, or other alteration of a dwellinghouse the construction of an external porch; and the painting of a dwellinghouse, or of a building or enclosure within its curtilage.
Article 4 (2) Directions may also be used in a Conservation Area to withdraw the permitted development rights to demolish a gate, fence, wall or other means of enclosure, if it is within the curtilage of a dwellinghouse and fronts a highway, waterway or open space.
Each Article 4 Directions may differ in accordance with the specific permitted development rights which are considered harmful to the specific Conservation Area in question.
