What is Local Housing Allowance?
Local Housing Allowance (LHA) is a new way of working out Housing Benefit for some private tenants. The new scheme came into effect on 7th April 2008 and is designed to be a fairer and simpler way of working out Housing Benefit for people on a low income.
The scheme changes the way benefit is worked out and how it is paid.
Who will be affected?
- Private tenants who make a new claim after 7 April 2008
- Existing claimants who have a change of address and move to a private tenancy
- Existing claimants who have a break in their Housing Benefit claim after 7 April 2008 of more than one week
LHA will not affect :
- Tenants of Housing Associations
- Tenants whose tenancy commenced before 15th January 1989
- People who live in hostels
- People who live in caravans, houseboats, mobile homes
- Cases where a substantial part of the rent is for board and attendance
- People in supported housing provided by certain local authorities, social landlords, charities and voluntary organisations
Existing claimants will remain on the current Housing Benefit scheme until one of the above events takes place.
What's different about LHA?
The LHA will be dependent on the household size and make-up rather than the actual rent which a landlord charges for a dwelling. If the actual rent is less than the LHA for the type of property the tenant needs, the tenant will be able to keep the extra money up to a maximum of £15 per week. However if the actual rent charged is greater than the LHA, the tenant will have to pay the difference to the landlord. Also, payments will usually be issued directly to tenants.
